Some new development on the issue has come from recent cases of cricket scores being treated as public data or copyrighted data. The outcome of this case will also have a bearing on the issue of NSE owning stock market data, Links to details of the cases can be found below:

I was also told that DotEx has gone ahead beyond legal notices. For those not abiding, they have also filed cases in the court.

This is just the beginning.

There are many illegal data providers. as far as i know only Global data feed is legal and authorized. The rest of many amibroker and MT4 data providers are illegal and will soon get into trouble just like Manshi.

A lot of data providers use Yahoo/Google data. They have to be sued by those companies, if at all. Don't know from where google/yahoo get their data and under what contract.

Those using NOW data and forwarding it to through their softwares might be in trouble. But their too, the database in the current form is copyrightable. If they are modifying the data, will the original copyright still hold? That is something which will be interesting to see.

Lets see what counter arguements Godaddy/Manshi provide and how does the courts see the whole issue. It will definitely be very interesting and a landmark case for sure.

IMHO, if it is copyrighted, modification of copyrighted data wouldn't be allowed in first place.

The data is not copyrightable. It is the arrangement of data, or the database as we call it.

Adaptation of copyright is also legal, provided there is significant contribution. What is "significant" is for the courts to interpret.

Market price is copyrightable?
That is one outcome which will be keenly watched. Whether market price can be copyrightable. However, in the article, I see that they have only sued based on the use of their database and not the market quotes.

This is similar to cricket scores case going involving Star and Cricinfo etc. The outcome of that case will also have a bearing on this case.
