You can get back money only if some one buys the shars held by you. Now tell me who is going to buy shares of a company, which has been suspended from exchanges? A little knowledge about the legal framework of company may be essential for you. The essence of company as per Indian Companies Act is its dual personality. That means, company is having a seperate identity than its promoters. In simple terms, individual promoters are NOT PERSONALLY LIABLE for the losses made by the company. Their individual and personal properties cannot be held responsible or made liable for making repayment of money invested by you on the shares of the company. In other words, if the company dooms, promoter has no liability and needless to say, the money invested on its shares is also lost. If the company is liquidated, firstly all secured creditors (that means banks, financial institutions etc. who have advanced money or goods to the company on the security of the assets of the company) will be paid. If something still remains after making payments to these secured creditors, then all unsecured creditors (that means investors in unsecured fixed deposits made in the company, ordinary suppliers to the company etc. etc.) will be paid their dues. If some thing still remains even after paying unsecured creditors, then comes the turn of shareholder. Now kindly note that, if a company is suspended from bourses, that means, the promoters have not complied with the listing requirements. That means, company is already doomed. Who is going to purchase the shares of a doomed company? Why should a person purchase the shares of a doomed company? Obviously, purchasing shares of a doomed company means throwing money out of window. Interestingly, members do you remember the mad scramble for puchasing the shares of Global Trust Bank on last day of its trading by several gullible persons, just because it was available for less than 50 paise? There are many number of ways of cheating public by forming a company. I have seen some of them. Do you remember the plight of depositors of CRB Capital Markets, Lloyd Finance (list is endless) etc.? Why did not they get back their deposits? Because, it was an unsecured one and the company had absolutely nothing to pay even the secured debts. Next time when you think of making a deposit in a company, remember, it is always unsecured one and therefore, remember not to make it in a company with doubtful promoters.
